What is the chance of me an my husband getting custody of our one year old son?


I was 19 when I had my son I still lived at home with my parents when my son was 6 months old I moved out an left my son with his grandmother till I got moved in. I went back to get him an she refused to let me have him.went to see him every weekend while he was there. up an until she went to court an now has temporay custody of him I get to see him every weekend how will I go about getting him back I mean hes been with her sence birth an really is not use to me that much an crys. would that be a promble? Help Please

Courts are in favor of parents, especially if your married ANND able to provide support for your son-not just monetary.

Grandmother would only have a case against you if she can prove that it's harmful for the child to be in your custody, i.e. child is exposed to drugs, alcohol, etc....

I don't know how long your son's been at the Grandma's, but she may be saying you abandonded the child and to be honest, a huge part of your case will depend on the judge, will the Grandmother prove to be better able to provide care?
