12yo grandaughter lives with mum wants to live with dad court has given shared custody but to reside at mums?


Grandaughter was 6 when assulted by her mum's dad and 12 when assulted by her mum's boyfriend both assults in the same home.
What age does she have to be to choose where to live and if she can live with her dad does it need to go to court.

Custody is always decided by the court. Her father can petition the court for custody to see if he can obtain it now.

The age a judge listens to a child varies from state to state but most states, the child has to be a minimum of 10 years old...some states, older than that. Father would have to check what it is in his state. At 12, I would think she would have a say in most states.

No assaults to place. Grand parents are lieing scumbags that screwed up on their own kids and now want to 'make it right' taking the kids away from their daughters ex-husband or the grand kids dad.

Age varies from state to state so you can call attorney-no charge for phone consultation and they'll inform.I'm surprised her Mom has any custody and that she lives with her at all considering these assaults occurred esp. Mom"s boyfriend. Yes it should go through the court -if she's not safe with her Mom-if there is now no danger then unless her Dad wants full custody then has to go through court but keep in mind requires having Her Mom declared unfit. If there is now no safety issue would first arrange between Mom and Dad---But best is to get facts first from attorney-for phone consult free and once you know legal facts can then make better decision
Call family court. I beleive she can get a guardian ad liem. Or she can make her own request to be moved. In a shared custody there should be no problem. Just let her know that she needs to tell the judge the whole truth about her situation so they can make a decision on her behalf. And not to say what everyone wants her to say. She need to think of her own safety.
